A BILL to amend and reenact section nine, article three, chapter
eighteen of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to the state
department of education generally; establishing the division
of school personnel and setting forth certain responsibilities
for the division.
Be it enacted by the Legislature of West Virginia:

That section nine, article three, chapter eighteen of the code
of West Virginia, one thousand nine hundred thirty-one, as amended,
be amended and reenacted to read as follows:
ARTICLE 3. STATE SUPERINTENDENT OF SCHOOLS.
§18-3-9. State department of education.

(a) For carrying into effect the provisions of this chapter,
the state superintendent of schools shall maintain a department of
education at his office at the state capitol, and he shall have authority to employ assistants and such other employees as may be
necessary.

(b) By the first day of July, two thousand three, there shall
be established within the department a division of school
personnel. The division shall operate within the department's
existing budget and with existing personnel, and nothing in this
subsection requires any level of funding or appropriation by the
Legislature. The division:

(1) Shall develop a uniform standard of employment;

(2) Shall advise counties in personnel matters;

(3) Shall provide information to the public and school
personnel regarding questions relating to personnel issues such as,
but not limited to, hiring, employment, seniority and
certification; and

(4) Is liable for the accuracy of any information or advice
provided pursuant to this section.

NOTE: The purpose of this bill is to establish a division of
school personnel within the state department of education by July
1, 2003.
